The Apud Acta (literally "alongside the minutes" in Latin) is a notarial record in which the notary documents declarations, statements, agreements, or facts that the parties make in their presence. Unlike a public deed, it does not elevate a legal transaction to public status, but simply attests to what is declared, granting it the maximum possible evidentiary value.
This notarial instrument is especially valuable when you need to leave official record of a will, an agreement, a factual situation, or a declaration that may be legally relevant in the future. The notary attests that the appearing persons made the statements contained in the minutes on the indicated day and time, with full capacity and knowledge.
The Apud Acta can document practically any lawful content: from agreements between partners on company management, to unilateral declarations on asset situations, to expressions of will on business strategies, waivers, consents, or any other act that the parties wish to have officially accredited.
