When might you need it?

The most common cases for this procedure

Parents who died in Spain, children abroad
Your parents lived in Spain and you and your siblings are spread across Europe or the Americas. The inheritance has to be accepted and nobody can spend weeks travelling.
A foreign national inheriting a home in Spain
Your relative owned an apartment on the coast. You know neither the Spanish system nor the language and need someone to handle it from beginning to end.
An inheritance with no will
There is no Spanish will. A declaration of heirs must be processed before the notary before the estate can be accepted and distributed.
The tax deadline is about to expire
Only a few weeks remain of the 6 months for Inheritance Tax. We apply for the extension where appropriate and file on time to avoid surcharges.
REQUIREMENTS FOR THIS PROCEDURE
Be an heir under a will or at law (spouse, children, parents, siblings and so on)
Valid ID and NIE for each heir (if you do not have one, we obtain it)
Death certificate, or the deceased's details so that we can obtain it
A list of the assets in Spain: property, accounts, vehicles

Do I have to travel to Spain to accept the inheritance?
Not necessarily. You give us the instruction and we coordinate the matter with a Spanish notary, who determines how each heir intervenes. Remote intervention is possible where the law allows it. We will tell you what can be done without travelling before you commit to anything.
How long do I have to accept?+
Inheritance Tax must be filed within 6 months of the death, extendable by a further 6 if applied for within the first 5. Acceptance itself has no deadline, but until the estate is accepted and distributed the assets cannot be sold or registered.
What if there is no will?+
A notarial deed declaring the heirs at law is processed, with two witnesses and the death and last wills certificates. We handle it as part of the instruction and the estate is then accepted and distributed.
How much Inheritance Tax is payable?+
It depends on the region where the deceased was resident, the family relationship and the value inherited. Between parents and children, many regions relieve almost the entire tax. We calculate it during the prior review, including where you are not resident in Spain.
Can I accept under benefit of inventory?+
Yes. If you suspect there are debts, acceptance under benefit of inventory limits your liability to the value of what you inherit. The notary will tell you whether it is advisable and how it is documented in your case.
How long does the whole process take?+
With the certificates and the will located, the notary usually has the deed ready within two or three weeks. Filing the tax and registration at the Land Registry take a further one to two months.
