Frequently asked questions

What is the difference between a domestic partnership and marriage?

A domestic partnership is a stable union between two people who live together without being married. Although it shares many rights with marriage (pensions, inheritances, employment benefits], there are some differences:

  • A domestic partnership requires proof of stable cohabitation, while marriage is established through the ceremony
  • Separation procedures are simpler for domestic partnerships
  • Some tax rights may vary depending on the autonomous community
  • Marriage has automatic recognition, domestic partnership requires registration or a notarial certificate

Both options are equally valid and the choice depends on each couple's personal preferences.

How long does the complete process take?+

The complete process is usually completed in 2 to 4 business days:

  • First contact and document verification: less than 24 hours
  • Certificate drafting by the notary: 24-48 hours
  • Coordination of the video conference: according to your availability
  • Digital signature and delivery: immediate after the meeting

If you have all the documentation prepared and good schedule availability, we can speed up the process even more.

Does the certificate signed online have legal validity?+

Yes, it has exactly the same legal validity as a certificate signed in person at a traditional notary office. The document is:

  • Drafted and signed by an officially certified notary
  • Protected with a recognized electronic signature according to Spanish legislation
  • Registered in the corresponding notarial protocol
  • Recognized by all public administrations and private entities in Spain

Law 24/2001 and Royal Decree 1553/2005 regulate the validity of electronic public deeds, guaranteeing their full legal recognition.

What if my partner lives in another city or country?+

No problem. One of the great advantages of the online process is that you don't need to be physically in the same place. Each of you can connect from your location during the video conference with the notary.

Both of you will need:

  • A stable internet connection
  • Your digital certificate or electronic DNI
  • The required documentation scanned

The notary will verify the identity of both individually and proceed with the digital signature of the certificate.

Do I need a digital certificate? How do I get one?+

Yes, you need a digital certificate or electronic DNI to sign the certificate electronically. If you don't have one, there are several quick options:

  • Electronic DNI: If your DNI was issued recently (since 2015], it already includes a digital certificate. You just need to activate it
  • FNMT Certificate: Apply for it online on the National Mint website. It takes 1-2 days
  • Cl@ve Permanente: Spanish public administration identification system

We send you a step-by-step guide to obtain your digital certificate in the fastest way. If you have questions, our team will help you through the process.

How much does the online domestic partnership certificate cost?+

The price includes:

  • Initial consultation and advice
  • Certificate drafting by the certified notary
  • Video conference and identity verification
  • Digital signature of the document
  • Delivery of the certificate in official electronic format

We provide you with a transparent quote with no surprises before starting the process. The cost is similar to or lower than a traditional notary office, with the advantage of saving time and travel.

Contact us for detailed pricing information.

Does the domestic partnership certificate expire?+

No, the notarial domestic partnership certificate does not have an expiration date. Once signed, it remains valid indefinitely as long as the relationship continues.

However, you should keep in mind that:

  • If you separate, you must officially communicate it through a new dissolution certificate
  • If you get married, the domestic partnership is automatically dissolved
  • For some administrative procedures (such as residence permit renewal] you may be asked for updated supplementary documentation proving that cohabitation continues

The certificate itself remains valid, but it is important to keep your registration updated if there are changes in the situation.

Can I register my domestic partnership in the registry later?+

Yes, the notarial certificate is a valid document for registering your domestic partnership in the corresponding registry of your autonomous community or city hall.

The registration process depends on each administration:

  • Some communities have autonomous domestic partnership registries
  • Many city halls maintain municipal registries
  • Requirements and deadlines vary depending on the locality

Important: Notario.org only handles the notarial certificate, we do not perform registration in administrative registries. However, the certificate you obtain is the main document you will need to register wherever appropriate.

We advise you on where and how to register according to your autonomous community.

What rights do I get with the domestic partnership certificate?+

The domestic partnership certificate allows you to access numerous legal rights:

  • Labor rights: leave for partner illness, company social benefits
  • Social security rights: survivor pension, benefits in case of death
  • Inheritance rights: protection in successions, although it is advisable to supplement with a will
  • Tax rights: deductions and tax benefits in some communities
  • Residence rights: family reunification for foreigners
  • Healthcare rights: medical decision-making, access to clinical information
  • Adoption rights: possibility of adopting jointly

Specific rights may vary slightly depending on your autonomous community.

Can I dissolve the domestic partnership later?+

Yes, you can dissolve the domestic partnership at any time through:

  • Notarial dissolution certificate: Similar to the establishment process, both of you sign a document before a notary (can also be done online]
  • Unilateral request: In some cases, one of the members can request dissolution without needing mutual agreement
  • Marriage: If the couple gets married, the domestic partnership is automatically dissolved
  • Death: The union is automatically dissolved upon the death of one of the members

The dissolution process is generally simpler and faster than a divorce, without the need for complex legal proceedings. If you need to dissolve your domestic partnership in the future, we can also handle it online.

Does the notarial deed replace registration in my region's registry?+
It depends on the autonomous region: in some, the deed is constitutive; in others, it complements registration in the regional registry. We'll advise you based on your specific case.
What are the requirements?+
Being of legal age, not being married or in another registered partnership, and in some regions, proving prior cohabitation. We'll review your region's requirements together with you.
Does this work if my partner is a foreign national?+
Yes, it's one of the most common uses for regularizing a partner's residency status.
Do documents signed online have the same validity as those signed in person?+
Exactly the same. Law 11/2023 recognises the full legal validity of notarial documents executed by video call with a qualified electronic signature before a registered notary.
Do I need a digital certificate?+
Yes, to sign electronically you need a digital certificate or an electronic DNI. If you do not have one, we help you obtain it quickly before your appointment, with no additional handling fee.
Can I do it from abroad?+
Yes, the notarial video call works from any country. You only need a stable connection, your valid identity document and a digital certificate.
How much does this service cost?+
The quote includes the official notarial fees set by the Notarial Association plus our handling, fixed before you start and with no hidden costs. Request it with no obligation via WhatsApp or the form.
What if I have questions during the process?+
Our team supports you from start to finish via WhatsApp, phone or email, and the notary answers all your legal questions before signing.
