Siblings in three countries

Frequently asked questions

Can the partition go ahead if one heir does not agree?−
Notarial partition requires every heir to sign. Without agreement, the remaining routes are partition by a testamentary distributor, where the will provided for one, or the courts. We explain the options during the prior review; we do not promise an outcome that depends on others.
Do I have to travel to Spain?+
Not necessarily. We coordinate the matter with a Spanish notary, who determines how each heir intervenes. Remote intervention is possible where the law allows it.
What is an excess allocation?+
It arises when an heir receives assets worth more than their share. If they compensate the others in cash, it may be taxed as a transfer, except for indivisible assets such as a home. We plan it so that you do not pay more than necessary.
How are the assets valued?+
Using the Cadastre reference value as the tax floor and, if the heirs so wish, an independent valuation. We work with objective values so that nobody feels short-changed.
Can I sell my share without a partition?+
You may sell your hereditary share, but buyers are hard to find and the other heirs have a right of pre-emption. It is almost always better to divide the estate first.
How long does it take?+
It depends on the agreement between the heirs. With everyone in agreement, the notary usually has the deed ready within two or three weeks, and registration takes a further two to four weeks.
