Gift a home in Spain with a prior review by the notary

Gifting a property has tax consequences for the person who gives and for the person who receives. The notary reviews your case before anything is drawn up and determines how you may intervene if you live abroad.

Gifting a home in Spain is not simply a matter of signing: the recipient pays Gift Tax, which varies considerably by region and by family relationship, and the donor may be taxed in their IRPF on the capital gain even though no money changes hands. That is why this service begins with a prior review: we analyse the transaction, the taxation for both parties and the alternatives (a sale, a succession agreement where one exists, a gift with reservation of a life interest). The notary then determines the legal structure and the form of intervention, with remote intervention possible where the law allows it.

When might you need it?

The most common cases for this procedure

Parents gifting to a child
They want to pass on the home ahead of the inheritance. The regional relief and the effect on the parents' IRPF both need to be considered.
A donor living outside Spain
The property is in Spain and the donor in another country. The competent region and the taxation change depending on where each party is resident.
A gift with reservation of a life interest
The bare ownership is gifted and the parents keep the use of the home for as long as they live.
A home with an outstanding mortgage
Gifting a mortgaged property is treated differently for tax purposes. It has to be examined beforehand, not afterwards.

Why is a prior review needed?
Because a badly framed gift can cost more than a sale. The recipient pays Gift Tax and the donor may be taxed in their IRPF on the gain. The notary reviews your case and tells you what is advisable before anything is signed.
Can I make the gift without travelling to Spain?+
It depends on your case. The prior review determines which form of intervention applies in law and whether remote intervention is possible. We do not promise it in advance: we confirm it after the review and before you commit to anything.
How much is payable on the gift of a home?+
The recipient pays Gift Tax, heavily relieved between parents and children in several regions, and the municipal capital gains tax. The donor declares the capital gain in their IRPF, or in the IRNR if not resident in Spain. We calculate it during the review.
Is it better to gift now or leave it in the will?+
It depends on the region, on the ages and on the circumstances of each party. We compare the figures during the prior review, without recommending either option in advance.
Can a gift be revoked?+
Only in the cases set out in the Spanish Civil Code: ingratitude, failure to meet attached obligations or the subsequent birth or survival of children. It is not a decision that can be reversed at will.
What about the forced share of the other children?+
The gift may be taken into account and reduced in the future inheritance if it prejudices the forced share of the other heirs. The notary assesses this during the review.
