Stop sharing a property in Spain without travelling

One co-owner keeps the property and compensates the others. The notary reviews the case, settles the correct structure and avoids it being taxed as a sale.

When a home in Spain belongs to several people (siblings who inherited it, a couple who separated, partners who bought together) and one of them wants out, ending the co-ownership allows one co-owner to keep the property and compensate the others in cash. Properly framed, it is taxed at 1.5% stamp duty (AJD) instead of the 6% to 10% of a sale, but badly framed it is taxed as a transfer. Hence the prior review: the notary analyses the shares, whether the property is indivisible and the compensation, and determines the form of intervention, with remote intervention possible where the law allows it.

Frequently asked questions

Why is a prior review needed?
Because the tax difference between getting it right and getting it wrong runs to several thousand euros. If the compensation does not match the shares or the property is not regarded as indivisible, the tax office may treat it as a sale. The notary reviews it before anything is signed.
How much tax is payable?+
Where it applies, stamp duty (AJD) of between 0.5% and 1.5% depending on the region, on the value of the property. If it is classified as a transfer, between 6% and 10%. We calculate it during the review.
Can I do it without travelling to Spain?+
It depends on your case. The prior review determines which form of intervention applies in law and whether remote intervention is possible. We confirm this to you before you commit to anything.
What if there is a mortgage on the home?+
Whoever keeps the property usually takes on the mortgage, and releasing the other party from the debt requires the bank's consent. We handle it, but the final decision is the bank's: we do not promise it in advance.
What happens if one co-owner will not sign?+
Ending the co-ownership before a notary requires agreement. Without it, the remaining route is an action for judicial division. We explain this during the prior review, with its timescales and costs.
Can the compensation be another asset instead of money?+
Yes, but it changes the tax treatment. That is another of the points settled by the prior review.
