Frequently asked questions

What exactly is a power of attorney for in a purchase and sale?

A power of attorney for purchase and sale legally authorizes another person (attorney-in-fact) to act on your behalf in all procedures necessary to buy or sell an asset. This includes:

  • Signing purchase and sale contracts and public deeds
  • Making payments and collecting the agreed price
  • Submitting documentation to registries and administrations
  • Negotiating operation conditions
  • Signing mortgage loans if necessary
  • Completing registry and tax procedures

The attorney-in-fact acts with the same legal powers you would have if you were present.

Is it mandatory to have a power of attorney for another person to sell on my behalf?+

Yes, it is absolutely mandatory. For another person to legally sign a purchase and sale on your behalf, they must have a valid power of attorney that specifically authorizes them to do so.

Without this document, any signature or procedure carried out by another person on your behalf would lack legal validity and the operation could be annulled. Property registries, notary offices, and public administrations require this requirement without exception.

The power of attorney guarantees that you have given your consent consciously and voluntarily before an official notary.

What information must the power of attorney include to be valid?+

For the power of attorney to be valid in a purchase and sale, it must mandatorily contain:

  • Complete data of the principal: full name, DNI/NIE/passport, address
  • Attorney-in-fact data: complete identification of the authorized person
  • Description of the asset: complete address, cadastral reference, vehicle registration, etc.
  • Specific powers: what specific acts they can perform (sign, collect, pay, register)
  • Limitations if any: minimum/maximum price, specific conditions
  • Duration or validity: until when the power is valid

Our notaries take care of drafting the document including all these elements correctly.

Can I grant the power of attorney from abroad?+

Yes, you can grant a power of attorney for purchase and sale from anywhere in the world in three ways:

1. Notarial video conference with Notario.org (fastest): Through digital identification and electronic signature before a licensed Spanish notary, completely online.

2. Spanish consulate in your country: Going to the nearest Spanish consulate, although it usually has appointments weeks in advance.

3. Local notary with Hague Apostille: Before a notary in your country of residence, then legalizing the document with apostille.

The online option is the fastest and most convenient, ready in 24 hours without waiting or travel.

How long does the power of attorney for purchase and sale last?+

The duration of the power of attorney is decided by you when granting it. The most common options are:

Specific temporary power: Valid only until completing the specific purchase and sale operation. It automatically expires after the signing.

Power with fixed term: Valid for a specific period (6 months, 1 year, etc.) for operations that may require more time.

Indefinite power: No expiration date, valid until you expressly revoke it.

For specific purchase and sales, the most common is to grant it only until completing the operation, ensuring that the attorney-in-fact cannot act afterward without your authorization.

How much does a power of attorney for purchase and sale cost?+

The cost depends on several factors: complexity of the power, value of the operation, and additional services. At Notario.org we offer personalized quotes without obligation.

The price includes: document drafting by licensed notary, signature video conference, digital certification, and complete guidance. If you need apostille for international use, it has an additional cost.

Contact us to receive an exact quote adapted to your specific case in less than 2 hours.

What do I need to sign the power by video conference?+

For the notarial video conference you need:

  • Valid identity document: valid DNI, NIE, or passport
  • Stable internet connection: WiFi or mobile data with good speed
  • Device with camera and microphone: computer, tablet, or smartphone
  • Digital certificate or identification system: we indicate how to obtain it if you don't have one
  • Purchase and sale information: asset data, approximate price, attorney-in-fact data

We send you detailed instructions before the video conference so everything is ready.

Can I revoke the power of attorney after granting it?+

Yes, you can revoke a power of attorney at any time as long as the operation has not been consummated. To revoke a power you must:

  1. Grant a revocation deed before a notary
  2. Formally notify the attorney-in-fact that the power is void
  3. Communicate the revocation to involved third parties (buyer, registry, etc.)

Once the attorney-in-fact has signed the purchase and sale using the power, it is consumed and the operation carried out can no longer be revoked. That is why it is important to grant specific powers with clear instructions about the limits of action.

Can the attorney-in-fact sell at any price or are there limits?+

You decide the limits when granting the power. You can establish:

Minimum sale price: The attorney-in-fact cannot sell below that amount.

Maximum purchase price: If it is for buying, maximum limit to pay.

Specific conditions: Payment form, deadlines, suspensive conditions, etc.

General power without limits: The attorney-in-fact freely decides the price (only recommended with people you completely trust).

The most common is to establish a minimum price or a range to protect your interests. Our notaries advise you on the best option according to your case.

Is the power of attorney valid for vehicles and properties equally?+

Yes, the same power of attorney can authorize you for the purchase and sale of both real estate (houses, apartments, commercial premises, land) and vehicles (cars, motorcycles, etc.).

However, it must clearly specify what type of asset is going to be bought or sold. You can include multiple assets in a single power if you are going to carry out several operations.

For vehicles, the power must include the make, model, and registration. For properties, the complete address and cadastral reference. Our notaries draft the document including all necessary specifications to be valid before Traffic Authority or Property Registry as appropriate.

Can the power of attorney be limited to a specific property?+
Yes, and it is advisable: we identify the property or vehicle and the conditions (minimum/maximum price) for your peace of mind.
Can it be used to sign the mortgage?+
It can include powers for the mortgage loan linked to the purchase. We state this expressly in the power of attorney.
What happens after the transaction?+
You can revoke the power of attorney at any time; we can also draft it with validity limited to the transaction.
Do documents signed online have the same validity as those signed in person?+
Exactly the same. Law 11/2023 recognises the full legal validity of notarial documents executed by video call with a qualified electronic signature before a registered notary.
Do I need a digital certificate?+
Yes, to sign electronically you need a digital certificate or an electronic DNI. If you do not have one, we help you obtain it quickly before your appointment, with no additional handling fee.
Can I do it from abroad?+
Yes, the notarial video call works from any country. You only need a stable connection, your valid identity document and a digital certificate.
How much does this service cost?+
The quote includes the official notarial fees set by the Notarial Association plus our handling, fixed before you start and with no hidden costs. Request it with no obligation via WhatsApp or the form.
What if I have questions during the process?+
Our team supports you from start to finish via WhatsApp, phone or email, and the notary answers all your legal questions before signing.
