Sell the property you inherited in Spain without travelling

A parental home that nobody will use
The siblings live outside Spain and prefer to sell and divide the proceeds.
An inheritance with a buyer already found
The agency has a buyer but the property is still in the deceased's name. It must be allocated and registered before it can be sold.
A sole heir resident abroad

Frequently asked questions

Can I sell directly without distributing the estate?
No. To sell, the property must be registered in the heirs' names. It is allocated and then sold, usually on the same day and before the same notary.
Do I have to travel to Spain?+
Not necessarily. We coordinate both transactions with a Spanish notary, who determines how each heir intervenes. Remote intervention is possible where the law allows it. We confirm this to you before you commit to anything.
What taxes are payable?+
On the inheritance: Inheritance Tax and municipal capital gains tax. On the sale: the 3% retention if you are not resident in Spain, municipal capital gains tax again and IRNR on the gain. We calculate all of it during the prior review.
How much tax is due on the gain if I sell soon after inheriting?+
The gain is the difference between the value declared in the inheritance and the sale price. If you sell for a figure close to the declared value, the gain is small. That is why it pays to declare the value correctly in the inheritance.
What if one of my siblings does not want to sell?+
The sale requires every co-owner to sign. Where there is no agreement, we explain the alternatives (buying out their share, ending the co-ownership, judicial division).
How long does it take?+
With complete documentation and a buyer, the inheritance and the sale can be signed within four to six weeks. Registration in the buyer's name takes a further two to four weeks.
