Give money to a relative in Spain with legal and tax certainty

A transfer between relatives is not a documented gift. The notary reviews your case, the tax is filed and the source of the money is on record.

Sending money to a child for the deposit on a flat or helping a relative in Spain seems straightforward until the tax office asks where it came from, or the bank requires evidence of the source of funds in a purchase. A cash gift is documented in a deed, the Gift Tax is filed in the region that corresponds and the money is traceable. This service begins with a prior review: we analyse who is giving, who is receiving, where each of them is resident and which relief applies. The notary then determines the form of intervention, with remote intervention possible where the law allows it.

When might you need it?

The most common cases for this procedure

The deposit on a flat for a child
The parents contribute part of the price. The bank and the notary handling the purchase will ask for evidence of that money.
Parents living outside Spain
The money leaves a foreign account and the child is resident in Spain. It must be established which region is competent.
Help to repay a mortgage
A relative contributes the outstanding capital. Documenting it avoids a tax problem years later.
Transfers already made
The money was sent without documentation. We assess whether it can still be regularised and at what cost.

Why document a cash gift?
Because without a document there is no evidence of where the money came from. In the purchase of a home, the notary and the bank require it under anti-money-laundering rules; and the tax office may treat it as an unjustified increase in wealth.
How much tax is payable?+
It depends on the region and on the family relationship. Between parents and children, several regions relieve practically the whole tax provided the gift is made in a public deed and the source of the money is evidenced. We calculate it during the prior review.
Which region is competent?+
For money, the region where the recipient is habitually resident. If the recipient lives outside Spain, national rules apply with the particular features of the IRNR. This is one of the points the prior review settles.
Can I do it without travelling to Spain?+
It depends on your case. The prior review determines which form of intervention applies in law and whether remote intervention is possible. We confirm this to you before you commit to anything.
Is a private agreement enough instead of a deed?+
Regional relief usually requires a public deed and a traceable bank transfer, not cash. The notary will tell you what your region requires.
What if the money was transferred months ago?+
The tax falls due when the gift is made, so a late-filing surcharge may apply. We assess this during the review before anything is moved.
