Frequently asked questions

How much time do I have to respond to the request?−
The deadline is set out in the request itself and is usually 10 business days from notification. Before it expires, you can request an extension of up to half the granted period. Be sure to calculate correctly when it starts: if the notification was electronic, it runs from when you accessed it or from when 10 calendar days passed without access.
What happens if I don't respond, or respond late?+
The AEAT will decide based on what it has, and if it sent the request, it's because what it has isn't enough: denial of the registration is the almost certain outcome. Furthermore, a case denied due to lack of response complicates any future application, since it remains on record that you failed to prove the business activity when asked.
Isn't it enough to just file Form 036 again?+
No. The request belongs to an already open procedure and must be answered within that procedure. Filing another Form 036 doesn't respond to anything, it duplicates cases, and it conveys to the AEAT exactly the opposite impression from the one you need: that of an orderly, genuine business.
I already submitted documentation with my application, why am I being asked again?+
Because what was submitted doesn't prove what the AEAT needs to verify: that there is genuine economic activity and specific intra-Community operations. It's common to submit a lot of paperwork but little useful evidence. The key to the response is addressing each questioned point specifically, not just dumping documents in bulk.
What if, despite my response, the registration is denied?+
The denial can be challenged through an administrative appeal or before the economic-administrative tribunal, and a new application can also be prepared correcting the causes that led to the denial, which is our ROI/VIES re-registration service.
