Revocation or renunciation of a power of attorney

What is the difference between revocation and renunciation of power of attorney?
Revocation is performed by the principal (who granted the power) voiding it. Renunciation is performed by the attorney-in-fact (who received the power) expressing that they do not wish to continue exercising the representation. Both require a notarial public deed.
How is a power of attorney revoked?+
Through a public deed before a notary. The principal appears, identifies the power to be revoked (date, notary, protocol number), expresses their will to revoke it, and signs the deed. Then the attorney-in-fact must be notified.
Is it mandatory to notify the attorney-in-fact of the revocation?+
Yes, for the revocation to have full effect against third parties, the attorney-in-fact must be formally notified. Until notified, the attorney-in-fact may continue to act and third parties in good faith may consider their actions valid.
How long does it take for the revocation to become effective?+
The revocation deed has immediate effect from the moment it is granted. However, to oppose it to third parties, it is advisable to notify the attorney-in-fact and, if the power is registered in a registry, to also register the revocation.
How much does it cost to revoke or renounce a power of attorney?+
Notarial fees for revocation or renunciation are lower than for granting a power of attorney. Approximately 40-70€ plus formal notification costs. Request an exact quote.
Can I revoke a power of attorney by video conference?+
Yes, many notaries allow granting revocation deeds by video conference with electronic identification. It is especially useful if you live far away or abroad.
What happens if the attorney-in-fact continues to act after the revocation?+
If they act knowing about the revocation, their actions are null and they may incur criminal liability (misappropriation, fraud). If third parties in good faith were unaware of the revocation, their actions may be valid, which is why notification is crucial.
Can the attorney-in-fact refuse the revocation?+
No, the attorney-in-fact cannot oppose the revocation. The principal has the absolute right to revoke the power at any time without needing justification or the attorney-in-fact's consent.
Does the attorney-in-fact need to justify their renunciation?+
No, the attorney-in-fact has the right to renounce without justification. However, they must notify the principal so that they can take measures (appoint a new attorney-in-fact or personally manage their affairs).
Can a power of attorney be partially revoked?+
Yes, you can revoke only some powers while keeping others in effect. In the revocation deed, you must specify exactly which powers are being eliminated and which remain.
Is it enough to tear up the copy of the power of attorney?+
No: the power of attorney remains valid until it is formally revoked. A notarial revocation served on the attorney-in-fact (and on third parties such as banks) is the only reliable method.
How does the attorney-in-fact find out?+
The notary provides certified notification. We also notify the institutions where the power of attorney was being used, if you let us know.
Can I revoke a power of attorney granted abroad?+
If it is a Spanish power of attorney, yes. If it was granted before a foreign notary, we will guide you on the correct procedure.
Do documents signed online have the same validity as those signed in person?+
Exactly the same. Law 11/2023 recognises the full legal validity of notarial documents executed by video call with a qualified electronic signature before a registered notary.
Do I need a digital certificate?+
