The power of attorney for litigation authorizes the lawyer and court representative (procurador) to act on behalf of the company in any jurisdiction: civil, commercial, labor, administrative litigation, and criminal. Is it mandatory to grant a notarial power of attorney for a lawyer to represent me in court?

Yes, it is mandatory in most judicial proceedings in Spain. The Civil Procedure Law requires that lawyers have a notarial power of attorney to be able to act on behalf of their clients, especially in civil proceedings.

Without this document, the lawyer cannot file lawsuits, appeals, or sign procedural documents on your behalf. It is an essential legal requirement to guarantee that the representation is legitimate.

Can I limit the power to only one specific judicial proceeding?+

Yes, you can grant a notarial power for lawsuits limited exclusively to a specific case. In this case you must specify:

  • Case or proceeding number
  • Competent court or tribunal where it is processed
  • Subject matter of the proceeding (civil, labor, criminal, etc.)
  • Parties involved in the litigation

You can also grant a general power that covers any present or future proceeding, according to your needs.

How long is this type of power of attorney valid?+

The notarial power of attorney for lawsuits has no automatic expiration date. It remains valid indefinitely until one of these situations occurs:

  • You expressly revoke it through a notarial deed
  • The attorney-lawyer formally resigns from the representation
  • The judicial proceeding for which it was granted ends (if it is a power limited to a specific case)

As long as it is not revoked, the power remains valid and the lawyer can continue acting on your behalf.

What happens if I need to change lawyers during the judicial process?+

You can change lawyers at any time during the proceeding. To do so you must:

  1. Sign a deed of revocation of the previous power before a notary
  2. Formally notify the former lawyer of the revocation
  3. Grant a new power of attorney to the new lawyer who will represent you
  4. Communicate the change of representation to the court where your case is being processed

What happens if the lawyer acts beyond the scope of the granted power?+

The lawyer has the legal obligation to act only within the limits and powers you have granted in the power of attorney. If the attorney-in-fact exceeds those powers or acts outside the authorized scope:

  • Their actions outside the power can be declared null
  • You can claim civil and professional liability
  • You must report the situation to the corresponding Bar Association
  • You can immediately revoke the power and demand compensation for damages
Can I sign the power of attorney from abroad?+

Courts of justice accept these electronic powers of attorney without any problem, since they are issued by official notaries and have all the legal guarantees of authenticity, signature, and electronic sealing.

Can I grant a power of attorney for lawsuits to someone who is not a lawyer?+

It depends on the type of judicial proceeding. In most cases in Spain, it is mandatory that legal representation be exercised by a certified lawyer.

However, in some proceedings of lesser amount or in verbal trials of lesser complexity, the law allows self-defense or representation by non-lawyer third parties. Consult us about your specific case for proper advice.

General or special power of attorney for litigation?+
The general power covers any current or future proceeding and avoids repeated notarial deeds. The special power is limited to a specific case and provides greater control. For companies with recurring litigation, the general power is usually worthwhile.
Which powers must be expressly stated?+
Waiving claims, settling, withdrawing, compromising, submitting to arbitration, and any powers involving early termination of proceedings (art. 25.2 LEC). Without them, your lawyer can't close a deal on the courthouse steps.
Can the apud acta procedure be used instead of a notarial power of attorney?+
It exists and is free, but requires a digital certificate and electronic or in-person appearance by a representative with current authority, and it only applies to a specific proceeding. For companies with multiple lawsuits, a notarial power of attorney is more practical.
