Frequently asked questions

What legal validity does a notarial mediation deed have?

The mediation deed signed before a notary has full legal validity throughout Spain. It is a public document that serves as proof of its content and can be judicially enforced without the need for prior trial if any party fails to comply with the agreement.

It has the same force as a final court judgment regarding the agreements reached between the parties.

How much does online notarial mediation cost?+

The cost varies depending on the complexity of the case and the amount in dispute, but generally ranges from €150-500, divided between the parties. This represents savings of 60-80% compared to the costs of a full court proceeding.

We provide an exact quote after analyzing your case in the free initial consultation.

How long does the mediation process take?+

The complete process is usually resolved in 48-72 hours from first contact. In more complex cases, it may extend to 1-2 weeks.

Compared to the 6-18 months an ordinary trial can take, the time savings are substantial.

Do both parties need to agree to mediate?+

Yes, mediation is a voluntary procedure. Both parties must be willing to participate and negotiate in good faith to reach an agreement.

If one party refuses to mediate or no agreement is reached, the traditional judicial route is always available.

What documents do I need to start mediation?+

You need:

  • ID, residence card, or passport of all parties involved
  • Documentation related to the dispute (contracts, invoices, emails, etc.)
  • Detailed description of the problem and each party's positions
  • Digital certificate for electronic signature
  • Stable internet connection for the video conference
What happens if the other party doesn't comply with the mediation agreement?+

The notarial mediation deed is an enforceable title. If any party fails to comply, you can go directly to judicial enforcement without the need for prior declaratory proceedings.

This means a judge can order forced compliance (seizure, eviction, etc.) much faster than in a normal trial.

Is mediation confidential?+

Yes, absolutely. Everything discussed during the mediation process is protected by notarial professional secrecy. Conversations and proposals cannot subsequently be used in court if no agreement is reached.

Only the final signed deed is public in nature, but the negotiation process is completely confidential.

Can I do notarial mediation if I live outside Spain?+

Yes, as long as the dispute is related to matters under Spanish jurisdiction. You only need an internet connection and a recognized Spanish or European digital certificate.

The online process allows you to participate from any country without the need to travel to Spain.

Do I need a lawyer for notarial mediation?+

It is not mandatory, although you can be assisted by a lawyer if you wish. The notary acts as a neutral mediator, ensuring the process is fair and legal.

In complex cases or high-value disputes, prior legal advice may be advisable.

What is the difference between mediation and notarial arbitration?+

In mediation, the parties reach the agreement themselves with the notary's facilitation. In arbitration, the notary-arbitrator hears both parties and issues a binding resolution.

Mediation is more flexible and parties have greater control over the final outcome. Arbitration is more similar to a trial, but faster and more economical.

Is the agreement binding?+
Yes: the agreement reached through notarial conciliation is recorded in a public deed and has executive force, just like a court judgment.
What if the other party doesn't show up?+
The failure to appear is officially recorded, which can support you in a subsequent court proceeding.
Which disputes cannot be settled through conciliation?+
Those involving non-disposable matters (civil status, minors, criminal matters). Conciliation is valid for all property and commercial matters.
Do documents signed online have the same validity as those signed in person?+
Exactly the same. Law 11/2023 recognises the full legal validity of notarial documents executed by video call with a qualified electronic signature before a registered notary.
Do I need a digital certificate?+
Yes, to sign electronically you need a digital certificate or an electronic DNI. If you do not have one, we help you obtain it quickly before your appointment, with no additional handling fee.
Can I do it from abroad?+
Yes, the notarial video call works from any country. You only need a stable connection, your valid identity document and a digital certificate.
How much does this service cost?+
The quote includes the official notarial fees set by the Notarial Association plus our handling, fixed before you start and with no hidden costs. Request it with no obligation via WhatsApp or the form.
What if I have questions during the process?+
Our team supports you from start to finish via WhatsApp, phone or email, and the notary answers all your legal questions before signing.
