These Terms govern the use of www.notario.org, as well as any other Agreement or legal relationship with the Provider (Data Controller) on a legally binding basis. Capitalised terms are defined in the relevant section of this document.
The User must read this document carefully.
The Provider grants Users access to and use of www.notario.org, subject to the following Conditions:
Notario.org is a brand of Digital Notary Advisory LLC. It is not a notary’s office, it is not part of the Spanish Notariat and it exercises no public function. It does not attest documents, does not execute deeds or notarial records and does not replace the notary in any of their functions.
What we do is management and coordination: we take your instruction and your documents, prepare them, send them to a Spanish notary’s office in our network, arrange the appointment or the video call and support you through the later steps, such as settling taxes or registering the deed, where that has been contracted.
The notary is an independent public officer. They apply the legal form each transaction requires, exercise their judgement of legality and are personally liable for the document they execute, under the Spanish Notaries Act and its Regulations. Neither the content of the deed nor the decision on how it is executed depends on Notario.org.
That is why we do not promise an outcome or a specific form of intervention: whether a transaction can be completed without you travelling, and how, is determined by the notary’s office after reviewing the case.
Without prejudice to any more specific provision of these Terms, all intellectual property rights, such as copyrights, trade mark rights, patent rights and design rights relating to www.notario.org are the exclusive property of the Provider or its licensors and are protected under the applicable laws or international treaties on intellectual property.
All trade marks - whether word marks or figurative marks - and all other trade marks, trade names, service marks, word marks, illustrations, images or logos appearing in connection with www.notario.org are, and shall remain, the exclusive property of the Provider or its licensors and are protected under the applicable laws or international treaties on intellectual property.
Unless otherwise stated and without prejudice to applicable law, Users shall not be entitled to claim damages against the Provider (or any natural or legal person acting on its behalf).
This shall not apply to damages to life, health or physical integrity, damages arising from the breach of essential contractual obligations such as any obligation strictly necessary to achieve the purpose of the contract, and/or damages caused by wilful misconduct or gross negligence, provided that www.notario.org has been properly and correctly used by the User.
The notary’s conduct: Notario.org is liable for its own management, that is, for gathering and preparing the documents, coordinating with the notary’s office and the steps it has expressly taken on. It is not liable for the notary’s conduct or for errors, delays, refusals or defects attributable to them, nor for decisions of registries, public bodies or banks. If an incident attributable to the notary’s office occurs, we help you channel the claim to them and, where that incident prevents the contracted service from being provided, the management fees are refunded in accordance with the Refund Policy.
Scope: except in cases of wilful misconduct or gross negligence, Notario.org’s total liability for any claim arising from the service is limited to the management fees actually paid for the instruction concerned, and does not extend to indirect damages, loss of profit or loss of opportunity. None of the above limits the rights that consumer legislation grants users acting as consumers on a mandatory basis.
The Provider reserves the right to modify or amend these Terms at any time. In such cases, the Provider shall duly inform the User of such changes. Such changes shall only affect the relationship with the User going forward. Continued use of the Service shall indicate the User's acceptance of the revised Terms.
