Power of attorney to litigate and collect company debts

Recovering an unpaid debt involves very distinct phases: out-of-court demand, order for payment proceedings (monitorio), enforcement and, finally, collection and granting of a receipt. Who can be my attorney-in-fact for litigation and collection?

Generally, it is granted to a certified lawyer or solicitor who will act on your behalf before the courts. It can also be another trusted person if it only involves extrajudicial collection procedures.

It is important that the attorney-in-fact has the necessary legal capacity (of legal age and in full possession of their faculties) and, in case of legal proceedings, it is recommended to be a legal professional to ensure adequate representation.

Can I limit the power to only a specific case?+

Yes, absolutely. The power can be limited to a specific legal proceeding (for example, a specific claim for payment), to a specific amount, to a particular phase of the process (first instance, appeal), or to a specific type of action.

You can also establish a validity period or specific conditions. This flexibility allows you to maintain control over the scope of the representation granted.

Is this power valid before any court in Spain?+

Yes, the Power of Attorney for Litigation and Debt Collection granted before a certified notary has full validity throughout Spanish territory, including first instance courts, labor courts, administrative courts, provincial courts, high courts of justice, and the Supreme Court.

Being a notarial public document, it has public faith and authenticity recognized by law, so any court must accept it without additional procedures.

How long does it take for the power of attorney to be ready?+

What is the difference between this power and a general power?+

The power for litigation and collection is specifically focused on procedural acts (judicial representation) and collection (claiming amounts). It does not authorize asset, commercial, banking, or administrative procedures outside this scope.

A general power, on the other hand, grants broad powers to manage assets, make purchases and sales, manage bank accounts, and other administrative acts. If you only need legal representation or collection, this specific power is more appropriate and limits risks.

Do I need to be in Spain to sign the power?+

This system is especially useful for Spanish nationals residing abroad, foreigners with interests in Spain, or people who due to reduced mobility or distance cannot go to a physical notary office.

Can I revoke the power after granting it?+

Yes, you can revoke the power at any time through a notarial deed of revocation. The revocation must be communicated to the attorney-in-fact and, if a legal proceeding is in progress, it must also be notified to the corresponding court.

What documentation do I need for the procedure?+

You need your valid identity document (ID, NIE, or passport), the complete details of your attorney-in-fact (full name, ID/NIE, and address), and optionally, information about the specific legal or collection matter if you want to define the scope of the power.

For electronic signature, you will need a digital certificate or permanent Cl@ve. If you don't have one, we can manage the signature by videoconference identifying you with your official document.

Does the power include powers to settle or withdraw from the lawsuit?+

It depends on how the power is configured. You can grant a power with special powers that include the ability to settle (reach agreements), withdraw from the proceedings, accept the claim, or submit the matter to arbitration.

These powers must be expressly stated in the document. If you want your attorney-in-fact to have these capabilities, you must indicate it at the time of the request. We will advise you on the implications of each option.

Why is the power to "collect and issue a receipt of payment" so important?+
Without it, the attorney-in-fact may win the case but cannot validly receive the money or issue a receipt to the debtor. This is the most common omission and the one that most delays the closing of files.
Can I limit the debt reductions they may accept?+
Yes, and it's highly recommended: for example, authorizing up to a 20% reduction or up to 12 months of deferral, requiring your express authorization for anything beyond that.
Is it suitable for debt collection agencies?+
Yes, and they often require it. Add the obligation to deposit funds into your account and to report periodically: without that, oversight becomes blurred.
Does it cover the enforcement of judgments?+
If expressly stated, yes, including requesting attachments and participating in auctions. It's advisable to include this from the start.
Is it compatible with the general power of attorney for legal proceedings?+
Yes, and they are often combined: the litigation power for procedural representation and this one for collection and negotiation matters.
Do documents signed online have the same validity as those signed in person?+
Exactly the same. Law 11/2023 recognises the full legal validity of notarial documents executed by video call with a qualified electronic signature before a registered notary.
Do I need a digital certificate?+
Yes, to sign electronically you need a digital certificate or an electronic DNI. If you do not have one, we help you obtain it quickly before your appointment, with no additional handling fee.
Can I do it from abroad?+
