Powers of Attorney: what they are and what they are for

A power of attorney allows a family member, a lawyer, or an agent to act for you: accept an inheritance, sell a property, litigate, deal with your bank, or apply for a foreign ID number (NIE). The difference between a useful power of attorney and one that leaves you exposed lies in the scope of authority granted: too narrow and it won't cover what you need; too broad and you're handing over a blank check.

An online power of attorney is a public document that you grant before a notary via video conference, giving another person the power to act on your behalf in a legal and binding manner.

This remote procedure offers the same legal security as the in-person procedure. The document is registered in the notarial protocol and has full validity throughout Spain.

You can use it for multiple transactions: banking operations, property purchases and sales, inheritance procedures, representation in contracts, and many other legal acts requiring your formal authorisation.

The main advantage is absolute convenience: you formalise the power from your home or office, saving time and travel without compromising the document's legal security.

What changes if you are in Valladolid

Particularities of Castile and León that affect your procedure, beyond the name of the city

Common law (Civil Code)
Castile and León is governed by the Civil Code: community property as the default regime, a two-thirds forced heirship share, and no succession agreements. Straightforward, but good to know before planning an inheritance.
A widely dispersed province
With more than 200 municipalities, many with fewer than 500 residents, the real alternative wasn't going to another notary's office—it was driving there. The video call solves exactly that problem.
Regional administration
As the seat of the Junta de Castilla y León, many procedures require notarized documentation for regional government matters: grants, tenders, and authorizations.
Notarial College of Castile and León
Notaries licensed in Spain, with documents registrable at any Land or Commercial Registry in the province.
APPLICABLE REGULATIONS: Civil Code, Arts. 806-822 (forced heirship) and 1344-1410 (community property) Law 11/2023 (notarial video call) Notarial Law, Art. 17 bis

Frequently asked questions in Valladolid

Does it work the same if I live in a village in the province?
Exactly the same: the process is online, so it makes no difference whether you're in the capital, in Medina del Campo, or in a town of 300 people. All you need is an internet connection, your ID, and a digital certificate.
What inheritance regime applies in Castile and León?+
That of the Civil Code: a two-thirds forced heirship share and community property as the default economic regime, without the particularities found in territories with their own civil law.
Can it be registered at the Valladolid Registries?+
Yes, the deed is submitted electronically to the competent Land or Commercial Registry in the province.
I don't have a digital certificate—can I still do this?+
We'll help you get one before your appointment, at no extra cost. It's the step that holds most people back, and we take care of it for you.
General or specific power of attorney?+
A general power covers many acts and avoids repeated notarial deeds, but grants broad authority. A specific power is limited to one transaction and can expire once it's completed. For acts of disposal (selling, mortgaging), we always recommend a specific power, with a minimum price and limited validity.
Can I revoke it whenever I want?+
Yes, at any time. But withdrawing the copy is not enough: you must execute a notarial revocation and formally notify the attorney-in-fact and the institutions where it was used. Until then, it remains effective against third parties.
Is a power of attorney signed by video call valid at any notary's office?+
Yes. It is a Spanish public deed like any other, with an electronic certified copy valid before notaries, registries, banks, and public authorities.
Does an online power of attorney have the same validity as an in-person one?+

Yes, it has exactly the same legal validity. The power granted via video conference before a notary is registered in the official notarial protocol and is fully valid throughout Spain.

The only difference is the format of appearance (remote vs in-person), but the resulting document has identical legal force and can be used for any legal transaction requiring a power of attorney.

What do I need to grant an online power of attorney?+

You need to have:

  • Valid ID or NIE
  • Digital certificate or recognised electronic signature
  • Device with camera and stable internet connection
  • Complete details of the person to whom you grant the power (name, ID, address)

The notary will indicate if you need any additional documents according to the specific type of power you are going to grant.

How long does the complete process take?+

The complete process is usually completed in 2-3 business days:

  • Request and advice: 24 hours
  • Documentation preparation: 1 day
  • Video conference with notary: 30 minutes
  • Signature and authorised copy delivery: 24-48 hours

In urgent cases we can speed up the procedure so it is ready in 24 hours.

Can I limit the powers in a general power?+

Yes, completely. The notary can draft specific clauses that limit the scope of the general power according to your needs.

For example, you can authorise banking transactions but exclude property sales, or allow operations up to a certain financial amount. The notary advises you to configure the power exactly as you need it.

How is a power of attorney revoked?+

To revoke a power of attorney you must:

  1. Attend the notary (in person or online) and grant a revocation deed
  2. The notary registers the revocation in the protocol, rendering the previous power ineffective
  3. It is recommended to formally notify the attorney-in-fact through notarial deed or certified mail

From the moment of revocation, the previous power loses all legal validity.

What is the difference between a specific and a general power?+

Specific power: authorises only for a specific and determined act (example: selling a specific property). It automatically extinguishes when the transaction for which it was granted is completed.

General power: grants broad powers for multiple transactions on an ongoing basis (managing assets, carrying out various banking operations, representation in various contracts). It remains in force until expressly revoked.

The notary will advise you on which is more convenient according to your particular situation.

Is it mandatory to use a power for inheritance procedures?+

It is not mandatory, but it is very practical when:

  • Heirs reside in different cities or countries
  • Some heir has difficulty travelling
  • You want to speed up the acceptance and division process
  • There are multiple heirs and you want to centralise procedures

The power avoids all heirs having to attend the notary simultaneously, significantly simplifying the estate procedure.

Can I grant a power if I live abroad?+

Yes, the online power of attorney is ideal precisely for these cases. You can connect via video conference from any country with the notary in Valladolid.

You only need a stable internet connection, your digitised documentation, and a Spanish digital certificate. The notary verifies your identity remotely and the procedure is completed without needing to travel to Spain.

How much does an online power of attorney cost?+

The cost depends on the type of power and its complexity:

  • Simple specific power: from 60-80 euros
  • General power: from 100-150 euros
  • Special powers (inheritances, property): consult according to case

We provide you with an exact quote before starting the procedure, with no surprises. The price includes notarial advice, video conference, document drafting, and protocol registration.

Can the attorney-in-fact renounce the granted power?+

Yes, the attorney-in-fact can renounce the received powers at any time. To do so they must:

  1. Formalise the renunciation through a public deed before a notary
  2. Communicate the renunciation to the power grantor
  3. Return the original power document if in their possession

From the moment the renunciation is formalised, the attorney-in-fact no longer has representation powers and cannot act on behalf of the grantor.
